Senate Bill 326 (Civil Code Section 5551) requires all HOAs and condo associations in California with 3 or more units to inspect all exterior elevated elements (EEEs) every 9 years. The first deadline was January 1, 2025. If your community has shared balconies, decks, walkways, or stairways, SB 326 applies to you β no exceptions.

Yes. Under California Civil Code Section 5551 and the Davis-Stirling Common Interest Development Act, HOA board members who fail to exercise reasonable care in maintaining common areas β including completing required SB 326 inspections β can be held personally liable for injuries or damages.
SB 326 requires inspection by a licensed structural engineer or architect β not a home inspector, not a contractor. The report must be PE-stamped and must document the condition of every EEE. A regular home inspection does not satisfy SB 326.
